Laurie Martin is a partner with Hoover Hull Turner LLP practicing in the areas of business counseling, risk management, complex litigation, and employment advice and litigation. She represents employers, healthcare providers, businesses of all sizes, and individuals in disputes involving significant operational, financial, and reputational risk. Her practice includes defending employers in discrimination, harassment, retaliation, wage and hour, restrictive covenant, and trade secret matters, as well as representing clients in ERISA, healthcare, and broader business litigation.

Laurie approaches each matter with disciplined preparation, strategic perspective, and practical execution. With experience spanning federal and state trial and appellate litigation, her goal is to position clients for success in court while creating leverage for efficient resolution when appropriate. She also advises employers on day-to-day operational and compliance matters, including conducting sensitive internal complaint investigations, to help clients address issues early and reduce the risk of escalating disputes.

Experience

Though all cases vary and none is predictive, Laurie’s experience includes:

Employment Litigation

  • Defending employers against claims involving discrimination, harassment, retaliation, wage and hour disputes, and related employment matters before the EEOC, state and local agencies, and in federal court.
  • Defending an employer and management company in district court and subsequent Seventh Circuit appeal affirming summary judgment and jury trial verdicts on hostile work environment and joint employment claims that the EEOC brought on behalf of 52 claimants.
  • Defending a judgment on appeal in favor of an employer on race discrimination claims brought under Title VII and Section 1981.
  • Defending companies facing interference and retaliation claims under the FMLA and ERISA.
  • Defending claims of defamation, blacklisting, and wrongful discharge.
  • Negotiating resolutions of employment disputes through mediation and settlement conferences.
  • Defending employers against claims under the Indiana Wage Claim Act, Indiana Wage Payment Act.
  • Representing employers in restrictive covenant, confidentiality, and trade secret disputes, including proceedings seeking temporary restraining orders and preliminary injunctions.

Employment Counseling and Compliance

  • Advising employers on hiring, discipline, termination, workplace investigations, and compliance matters.
  • Reviewing and updating employee handbooks, workplace policies, and record retention policies.
  • Conducting employee training on EEO, anti-harassment, timekeeping, evaluation, and discipline practices.
  • Drafting and advising on employment agreements, separation agreements, executive compensation agreements, and restrictive covenant agreements.
  • Advising employers on ADA accommodations, FMLA compliance, wage and hour requirements, and HIPAA compliance.
  • Serving as an expert witness regarding HIPAA in relation to medical record releases.

ERISA Litigation

  • Representing individuals and plan participants in ERISA administrative proceedings and federal litigation involving pension and employee benefit claims.
  • Representing a retiree in a pension benefits dispute.
  • Defending ESOP fiduciaries against breach of fiduciary duty claims.
  • Representing group health and welfare plans in benefits litigation.

Healthcare Litigation

  • Defending a judgment on appeal in favor of healthcare providers against a physician’s constitutional and occupational liberty claims.
  • Defending a physician in a medical malpractice jury trial.
  • Defending healthcare providers against negligent hiring, vicarious liability, and invasion of privacy claims relating to a medical record breach.
  • Defending challenges involving the Indiana Medical Malpractice Act, including to the damages cap and qualified provider status challenges.

Business Litigation

  • Defending businesses in disputes involving breach of contract, fraud, breach of fiduciary duty, conversion, and related business tort claims.
  • Representing a bank in commercial foreclosure proceedings, sheriff’s sale matters, and fraudulent transfer litigation.
